Criminal Justice Ethics for Everyone

In the general orders or in the personnel manual of virtually every police organization there is language about “ethics” and “integrity.” But what exactly does than mean? Ethics is an easy word to throw around and yet very hard to define.
Police officers are held to a higher standard than the general public, both on and off duty, but do we really understand why that is and how an organization can be confident that its employees always act with integrity? Here are just a few thoughts for all law enforcement personnel to ponder, from the chief executive to the newest recruit.
Ethics Must Come From The Top
The foundation to real world ethics has to come from management. A police manager who implements a “no gratuities” policy for his officers but thinks nothing of taking that weekly free dinner from the city’s best restaurant is going to soon lose control of his agency. The director who expects her troopers to enforce the traffic ordinances to the “letter of the law” regardless of who they pull over cannot expect those same cops to look the other way when she helps her neighbor get out of a speeding ticket. The sheriff cannot require his deputies to sell tickets to his re-election fundraiser and expect them to say “no” to that half price sandwich and free drink at the local diner.
If they really want an ethical organization, police managers have to take a long look in the mirror and decide to hold themselves to an even higher standard than they do their personnel.
Can You Train Someone To Be Ethical?
The problem with most police ethics training classes is that they aren’t particularly realistic. Does taking a free cup of coffee or a half price burger mean you are on a slippery slope to taking bribes from the guy who runs the local crack house? Of course not. But these courses tend to be filled with silly quizzes and scenarios (“a liquor store owner on your beat offers you a free bottle of pricey booze to walk with him to the bank’s night deposit drop in a high crime neighborhood, what do you do?”) that don’t really help cops make good decisions.
Police agencies need to find training that goes beyond the “just say no” theory of ethics and integrity and gives cops the real world tools to deal with the conflicts and temptations they may face on a daily basis.
Take Control
Regardless of where you work, you control your own ethical behavior. The word “ethics” literally means “habits.” Webster’s defines “integrity” as “a firm adherence to a code of especially moral values.” Regardless of how your managers, supervisors and co-workers behave, you have to make a conscious decision about your own moral and ethical behavior.
One of the reasons we get hired as cops is because we probably passed a rigorous series of tests and background checks that determined we were moral people. Police agencies tend to hire people with certain values, but then fail to do any “values maintenance” on those same employees.
Often, good cops begin to let go of their own moral codes when they become frustrated with management, the community, and the general arduous nature of the job. Don’t let this happen to you. Understand that you, and you alone, control your own beliefs and behaviors. Rationalizing reasons to lower your own standards based on the conduct of others or your own frustrations is dangerous on several fronts.
You are taking the central control of your own life and giving it away to others, which can lower your own self esteem and lead to a feeling of victim hood and eventually, entitlement. Philosophers such as Aristotle taught that we should study ethics if for no other reason that for our own happiness and well being.
When I’m Off Duty, I Can Do Whatever I Want, Right?
I teach a class titled “Tactical Intervention,” which focuses in part on our behavior off duty and how to successfully intervene when you see a fellow law enforcement officer engage is some potentially life altering and/or career ending behavior, ranging from driving drunk or risking their family life with an affair.
I not only teach officers how to get involved, but why they are obligated to do so. Many of us feel that what happens off duty stays off duty, but do you want to wake up in the morning after a night out with your shift mates and see the newspaper headline “Intoxicated Off Duty Cop Kills Family of Five in Fiery Crash?”
Ethics doesn’t just involve following the written rules; the core of ethical decision making and behavior is “doing the right thing.” Cops are supposed to serve as an example to the rest of the world on how to behave, and as individuals, we are obligated to be role models and teachers not only to the rookies, but to our friends, our subordinates, and especially ourselves. A great way to help decide what to do in a given situation is to ask yourself “can I live with myself and this decision tomorrow, next week, and next year?”
Too often we try to complicate the study of ethics by finding the gray areas. The important thing is to have clearly defined, black and white ethical standards and live them each and every day so that they become “habits” for all of us, regardless of position, assignment, or agency.

For LEJF bulletins opened after August 5, 2014, candidates may reapply twelve (12) months after the date of the failed test. The Los Angeles County Sheriff’s Department’s Out-of-State program enables you to complete the first six components of the DST hiring process in four days.
These components are: (1) written test, (2) Validated Physical Ability Test (VPAT), (3) P.O.S.T. mandated structured interview, (4) background interview, (5) fingerprinting, and (6) polygraph. Your ability to complete all six components is contingent upon you passing the written test, VPAT, structured interview, and background interview. If you successfully pass the written test, you will proceed to the VPAT. Once you successfully complete the VPAT, you will be assigned to a background investigator who will conduct an interview and review your completed Personal and Work History package, and all other required documents. Fingerprinting and polygraph examination will follow after successful completion of the background interview.   4. Example: “I apologize for the inconvenience. This policy is designed to protect your privacy. I have researched your case and found that your notification letter was delayed because of a computer-related problem.”
  5. Personalized. Listen to what matters most to your customer and find the solution that best resolves his/her concern(s) while following organizational policies and procedures.Example: “The computer problem has been fixed and I will make sure the letter is sent out today. If you prefer, I can also email a copy of the notification letter to your email address on file.”
  6. Responsive. Take action and be diligent in providing the assistance or information in a timely manner. Example: “As you requested, I will email the notification letter to your office. May I call you in 15 minutes to make sure you received it?”

 Emotional Tone – Is the message friendly and respectful?
 Action – Will your customer know what to do after reading your message?

VISION:
(1) Acuity - At least 20/70 in each eye without correction, correctable to 20/30 in each eye. Successful soft contact lens wearers are not required to meet the uncorrected standard as long as their corrected vision is 20/30 in each eye.
(2) Color perception - Anything other than minor hue impairment is disqualifying.

HEARING:
There may be no greater than a 25 dB loss in the better ear as averaged over the test frequencies of 500, 1000, 2000, and 3000 Hz. There may not be a peak loss at any of the test frequencies greater than:

30 dB at 500 Hz
30 dB at 1000 Hz
40 dB at 2000 Hz
40 dB at 3000 Hz

There may be no greater than a 35 dB loss in the worst ear as averaged over the test frequencies, and no peak loss greater than 45 dB at any of the test frequencies. In the case of a questionable, unusual, or borderline hearing loss, the applicant's record may be reviewed by the Occupational Health Program's Service Consultant for final determination of qualifications.

EXAMINATION CONTENT
The examination will consist of a written test, weighted 100%, assessing vocabulary, reading comprehension, writing clarity, spelling, grammar, deductive and inductive reasoning, and data interpretation.

Applicants must pass the written test to be placed on the Eligible Register.  Applicants who fail the written test may retake the test once every twelve (12) months.

The written test is not reviewable by applicants per Civil Service Rule 7.19.

SCORE TRANSFERS

ELIGIBILITY INFORMATION
The names of applicants receiving a passing score on this examination shall be added to the eligible register without indication of relative standing in the examination. Successful candidates will remain on the register for a period of eighteen (18) months following the date of eligibility. All names on the register are eligible for appointment. No person on the eligible register may compete for this examination more than once every eighteen (18) months.

SPECIAL INFORMATION

REAPPLY PROCEDURE
Applicants who have participated in the examination process for any one of the LEJF examinations listed above, and did not achieve a passing score, must wait twelve (12) months after the date of any failed test component to reapply for any of the LEJF examinations. Reapplying continuously will override the existing application and will cause a delay in the processing of the application. Only the most current application will be considered.

Applicants who do not agree to the work conditions and/or fail the background questionnaire section in the supplemental questionnaire may not reapply until twelve (12) months from the date of the failed component.

Applicants who withdraw from the hiring process during the background investigation period will have to wait twelve (12) months from the withdrawal date to reapply.

FAILURE TO APPEAR
If you fail to appear to the written test administration, you will not be able to reapply for the position for twelve (12) months.

DISQUALIFICATION
The background questionnaire section of the supplemental questions are utilized to ensure applicants meet the standards of the Los Angeles County Sheriff's Department.  Applicants who fail the background questionnaire section in the supplemental questions will be disqualified and will have to wait twelve (12) months from the date of the disqualification to reapply.

Candidates who receive a letter of disqualification as a result of their background
investigation:
  • will not be allowed to reapply for a period of twelve (12) months from the date of the disqualification AND
  • will be disqualified from all of the LEJF positions for which they have applied.
The above applies to candidates who were disqualified from previous LEJF examinations.

DUAL TRACK CAREER PATH
The Dual Track Career Path program was developed by the Los Angeles County Sheriff's Department to enhance continuity, stability, and accountability in the Los Angeles County correctional system and Patrol related functions. The Dual Track will allow sworn personnel to select, remain, and promote within their career path of choice: Custody, Patrol, or both.

When applicants complete the Deputy Sheriff Trainee employment application, they will be asked to select their career path. Applicants' career path selection at this time is not binding. The Department will do its best to accommodate the selected Career Path; however, upon graduation from the Sheriff's academy, new Deputies will be assigned accordingly dependent upon the needs of the Department. Once Deputies complete their probationary period they will be afforded the opportunity to re-evaluate their career path selection again.

Deputies who select a career path in Custody can remain and promote within Custody Division, until they elect to change their career path. Deputies who select a career path in Patrol and become patrol certified can transfer and promote throughout the Department.

The hiring process, selection requirements, academy curriculum, and monthly entry-level salary will remain unchanged. Deputies who elect a career path in Patrol, become patrol certified, and complete the required number of years will be eligible to receive additional pay.

VALIDATED PHYSICAL ABILITY TEST (VPAT)
Candidates who successfully pass the written test will be placed on an eligible register and will be scheduled for the Validated Physical Ability Test (VPAT) within two (2) weeks from the written test date, unless otherwise noted. The VPAT consists of pushups, a 75 yard run, arm endurance test, sit-ups, and 1.5 mile run.

Candidates will be allowed three (3) opportunities to pass the VPAT within a twelve (12) month period beginning from the date of the first scheduled VPAT appointment. Only candidates who pass the VPAT will proceed to the background investigation. If candidates do not pass the VPAT after the third opportunity, they must wait twelve (12) months from the date of their third VPAT opportunity to reapply for this examination. If a candidate fails to appear to any scheduled VPAT appointment without prior authorization from the Pre-Employment staff, the absence will constitute a failure and the candidate eliminates one of his/her three (3) granted opportunities. Applicants who withdraw from the hiring process during the VPAT must wait twelve (12) months from the date of withdrawal before they can reapply for the position.

BACKGROUND INVESTIGATION
The background process consists of a P.O.S.T. mandated structured interview, thorough background investigation, fingerprint search, and polygraph test. Examples of disqualifying factors discovered during this investigation include: the failure to appear to scheduled appointments, any felony convictions, job related misdemeanor convictions, certain serious traffic convictions or patterns of traffic violations (3 or more moving violations within the last year), at fault accidents, suspended license, driving under the influence, poor credit or employment history, substance abuse, and on probation.

APPOINTMENT INFORMATION
Candidates who successfully complete the background investigation and are selected for appointment, will be extended an offer of employment that is conditional upon the results of their medical examination, which includes a psychological evaluation.

ACADEMY TRAINING
The Sheriff's Academy training program is approved by the California Department of Corrections and the California Commission on P.O.S.T. It may take up to twenty-two (22) weeks to complete the academy. Classes are conducted Monday through Friday and some weekends and holidays. Academy days are generally eight and one half hours long and may be conducted in shifts. Recruits generally spend additional time outside of class preparing for class and studying for exams. Recruits in the Sheriff's Academy will participate in classroom and scenario-based training which will include: the interpretation and application of laws, report writing, radio operations, first aid and CPR, defensive tactics, handcuffing and searching techniques, use of the baton, the safe handling, care, and use of firearms, emergency vehicle operations, and Department regulations and laws regarding the use of force and firearms. Throughout the academy program, recruits will also participate in regular physical training. Knowledge, skill and task competence will be assessed. Academy success will be determined through multiple choice and true/false tests, role playing exercises, performance, physical ability, and work sample tests.

Selection Procedure:
All interested applicants must first sign-up and complete the written and physical tests administered by NTN (www.nationaltestingnetwork.com). Applicants must achieve a minimum score of 75% on the NTN video and 70% on the reading test. The report writing score is pass/fail, as is the physical test. This Physical Agility Test includes: a mile and a half run, a 300m sprint, push-ups and sit-ups (minimum 160 points needed for a passing score).

Those who pass this initial phase will be contacted by the King County Sheriff’s Office to participate in an examination process consisting of the following:
ORAL BOARD: Qualified applicants will be invited to an oral scored examination to evaluate their experience, education, and personal preparation for the position.

BACKGROUND INVESTIGATION: Candidates who are successful in the examination process will be subjected to a comprehensive background investigation.

POLYGRAPH: Candidates who successfully pass the background investigation will be required to take and pass a polygraph test.

The primary duties of this class are in support of the County's Sheriff's Office law enforcement functions. Responsibilities include protecting life and property, enforcing laws and ordinances, and investigating crimes throughout Snohomish County.

  1. Patrol unincorporated Snohomish County to deter and discover crimes; conduct crime scene investigations; enforce laws and ordinances; render public assistance as needed.
  2. Respond to reported crime scenes; take action to secure the scene; interview victims and witnesses; gather and preserve evidence; arrest suspects; prepare required reports.
  3. Investigate and report accidents; administer emergency first aid until aid car arrives.
  4. Issue notices of infraction and citations to violators of state laws and county ordinances; serve warrants of arrest.
  5. Interview and investigate citizen complaints; respond to inquiries; provide information to the public on laws and ordinances; assist in resolving problems; make referrals to appropriate agencies as necessary.
  6. Guard prisoners at hospitals and/or in court; transport prisoners to and from jail and court.
  7. Prepare required reports and maintain necessary records.
  8. Testify as a credible witness in court as required.
STATEMENT OF OTHER DUTIES
 
  1. May perform duties in specialty units in accordance with policies of the unit, and depending on experience.
  2. May supervise activities of volunteer personnel.
  3. May perform the duties of Sergeant.
Minimum Qualifications
     High school diploma or GED certificate. An associate of arts degree or 90 credits of college level course work including courses in law enforcement, criminal justice, or a closely related field is preferred. Must be United States citizen; minimum 21 years of age, no maximum age. Must pass job related tests.

SPECIAL REQUIREMENTS

A valid Washington State Driver's License, unrestricted except as to vision, is required prior to appointment.

Must pass a Civil Service examination; AND pre-employment examinations including, but not limited to, a complete background investigation, fingerprinting, criminal record check, polygraph examination, a medical examination and a psychological evaluation.
 
Employees must be armed at all times while on duty and must carry official office identification when armed. Must qualify with a firearm on a regular basis.

WORKING CONDITIONS
 
     Positions in this class typically require daily dealing with distraught or difficult individuals; standing for prolonged periods; work outdoors possibly in inclement weather; operate a motor vehicle on public roads for travel throughout the county; exposure to hazardous materials, diseases, and airborne/blood borne pathogens; daily wearing protective gear and equipment; precise control of fingers and hand movements; daily strenuous physical tasks; and lifting, moving and carrying objects over 20 pounds
 
      Shift, holiday and weekend work are required. Overtime and call back may be required.

  • Applicant must achieve a passing score of at least 80% on the video section of the written exam. Applicant must also pass the reading and report writing sections and the physical fitness test. The Physical Fitness Test includes: a mile and a half run, a 300m sprint, push-ups and sit-ups (minimum 160 points needed for a passing score).
  • Qualified individuals will be invited to participate in an oral board interview to evaluate their experience, education and personal preparation for this position. A passing score of at least 70% is required on this portion of the testing process.
  • Veterans' scoring criteria will be granted in accordance with RCW 41.04.
  • Applicant's eligibility on the Civil Service eligibility list will be valid for one (1)year.
